"When = Terry=20 Fortson was getting prepped for routine surgery to correct a = bunion=20 and hammer toe on his left foot last winter, he watched as = medical=20 personnel made markings to ensure the correct foot was = operated on.=20 But when Mr. Fortson, 60, of McKeesport, woke up from his=20 anesthesia, it was his right foot -- the wrong foot -- that = was=20 bandaged. In his lawsuit, he is alleging negligence for the=20 facility's failing to provide proper care. Among his claims, = Mr.=20 Fortson said he suffered mental anguish; pain and permanent=20 deformity of his right foot; an increased risk for future = problems=20 with the right foot; and loss of enjoyment of life. He is = seeking at=20 least $75,000 in damages."

People contract Legionnaire's through aspiration, = when=20 bacteria are inhaled into the lungs while drinking water or = inhaling=20 mist from a contaminated source, such as a shower or hot = tub.=20 Legionnaire's, with an average fatality rate of 28 percent, = is=20 estimated by the CDC to be responsible for up to 20,000 = cases in the=20 United States every year. About 35 percent of all cases are = acquired=20 in hospitals, where the death rate from infection can be as = high as=20 40 percent, the CDC said. Officials = emphasized that=20 most patients would be sent to group homes or other = community=20 settings after a detailed planning process. "We definitely = won't=20 discharge anyone who's not ready to go," said Joan Erney, = deputy=20 director for the state Office of Mental Health and Substance = Abuse=20 Services. Some could be sent to other state facilities such = as=20 Torrance State Hospital in Westmoreland County, though = officials=20 emphasized that they hoped to place most residents in the = community.=20 Some had questions about a proposal by Rep. In decades of research about student performance, = race,=20 socioeconomic status, age and gender have been tagged as the = top=20 predictors for absenteeism. The new study, in the latest = issue of=20 the journal Obesity, concludes that weight tops them all, = Geier=20 said. Nationally, obesity rates have nearly quintupled among = 6- to=20 11-year-olds and tripled among teens and children ages 2 to = 5 since=20 the 1970s, according to the Centers for Disease Control and=20 Prevention. The study adds to growing research into = non-medical=20 complications of being fat, including data suggesting that = obese=20 adults miss more workdays and go to college less frequently = than=20 people of normal weight, Geier said."

However, the = findings also=20 show that Part D plans provide less financial protection = against=20 high out-of-pocket drug spending and cost-related = nonadherence than=20 either employer plans or the VA. "More than a quarter of all = seniors=20 reported spending at least $100 per month on their = medications, and=20 8 percent reported spending $300 or more each month," the = authors=20 write. Future research, they say, should focus on = identifying the=20 factors that contribute to high out-of-pocket spending among = Part D=20 enrollees including the coverage gap known as the "doughnut = hole,"=20 formulary restrictions, and cost-sharing requirements. = Additional=20 research also is necessary to track the experiences of the = most=20 vulnerable beneficiaries to assess the long-term effects of = the=20 Medicare drug benefit on those with the greatest health=20 needs."

UPMC=20 POSTS RECORD $618 MILLION PROFIT

"The = University=20 of Pittsburgh Medical Center marked another set of = chart-topping=20 milestones yesterday with the news of a record $618 million = profit=20 during fiscal 2007, up 18 percent, and an all-time high of = $6.8=20 billion in revenue. This, after all, is the fifth straight = year of=20 robust profit increases for Oakland-based UPMC -- in fiscal = 2002,=20 its "excess margin" was $23 million, before climbing to $61 = million=20 in 2003, $248 million in 2004, $291 million in 2005 and $525 = million=20 in 2006. During that same period, revenues doubled from = $3.36=20 billion to the $6.8 billion reported yesterday. More = remarkable is=20 that three and a half decades ago, UPMC was merely a loose=20 federation of six hospitals with 500 employees and annual = revenue of=20 $10 million. Now the 19-hospital system employs 45,000, = making it=20 the largest employer in southwestern Pennsylvania by a wide = margin=20 -- it added another 2,000 people in fiscal 2007, including = 170=20 physicians. Its market share in Allegheny County is 47.9 = percent, up=20 from 46.7 percent in 2006, and it will surely exceed 50 = percent if=20 UPMC receives approval for its proposed acquisition of Mercy = Hospital of Pittsburgh."

Pennsylvania recently raised its limit to = 300=20 percent, from 200 percent. In his letter, Mr. Smith set a = high=20 standard for states that want to raise eligibility for the = child=20 health program above 250 percent of the poverty level. = Before making=20 such a change, Mr. Smith wrote, states must demonstrate that = they=20 have =E2=80=9Cenrolled at least 95 percent of children in = the state below=20 200 percent of the federal poverty level=E2=80=9D who are = eligible for=20 either Medicaid or the child health program. Deborah S. = Bachrach, a=20 deputy commissioner in the New York State Health Department, = said,=20 =E2=80=9CNo state in the nation has a participation rate of = 95 percent.=E2=80=9D And=20 Cindy Mann, a research professor at the Health Policy = Institute of=20 Georgetown University, said, =E2=80=9CNo state would ever = achieve that level=20 of participation under the president=E2=80=99s budget = proposals.=E2=80=9D The=20 Congressional Budget Office has said that the = president=E2=80=99s budget,=20 which seeks $30 billion for the program from 2008 to 2012, = is not=20 enough to pay for current levels of enrollment, much less to = cover=20 children who are eligible but not enrolled."
